OFFICIAL CONTEST RULES
1.1 The “Zest by Zantac” Contest (the “Contest”) begins on November 8th, 2018 at 0:00:01 (EDT) (the “Contest Start Date”) and ends on April 3rd 2019 at 23:59:59 (EDT) (the “Contest End Date”). The period between the Contest Start Date and the Contest End Date is the Contest period (the “Contest Period”).
2.1 To be eligible to participate in the Contest, a participant must be a natural person who is a legal resident of a Canadian province or territory and has reached the age of majority in his or her province or territory of residence at the time of participation in the Contest.
2.2 Employees of Sanofi Consumer Health Inc. (the “Sponsor”), its affiliates, promotion agencies, representatives and agents involved in the development, production and distribution of material related to this Contest (collectively, the “Contest Entities”), and any person which whom such persons reside are not eligible to participate in the Contest.
3. How to Participate in the Contest
3.1 No purchase necessary. To participate in the Contest, a participant (the “Participant”) must sign up to the Zest by Zantac program on Zantac website (www.zantac.ca) or on the Facebook page of Zantac Canada. Limit of one (1) entry per person, during the Contest Period. The Participant will obtain one (1) entry into the draw (as described in Section 4) (an “Entry”) upon submitting a valid entry in compliance with these Rules.
Any sharing of the link to the Contest Page by any Participant must comply with the Facebook and Zantac website terms and conditions of service. Standard text messaging and/or data rates apply. Wireless service providers may charge for airtime for each standard text message sent and received. Please call your service provider for pricing and service plan information and rates before mobile device participation. For greater certainty and the avoidance of any doubt, a Participant can only use one (1) Facebook account or one email address to participate in the Contest. Each Participant represents that his/her posting or sharing do not violate any law, statute, ordinance or regulation and will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, and is not defamatory, trade libelous, pornographic or obscene, and will not contain references to any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor; conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.
3.2 In the event of a dispute regarding an Entry, the Participant will be deemed to be the authorized account holder of the e-mail address associated with the Entry at the time the Entry was validated. For the purpose of these Rules, “authorized account holder” of an e-mail address shall mean the individual who has been assigned the e-mail address by the relevant Internet access provider, on-line services provider or other organization responsible for assigning e-mail addresses for the domain name associated with the e-mail address. The Participant may be required by the Sponsor to provide proof that he or she is the authorized account holder of the e-mail address indicated on the chosen Entry.
3.3 All information provided by the Participant for the purposes of the Contest must be truthful, accurate and complete. The Sponsor reserves the right to disqualify any Participant whose Entry contains false, incorrect or incomplete information.
3.4 The Sponsor may request proof of identity or of eligibility from the Participant at any time. Failure to provide such proof within a reasonable time may lead to the disqualification of the Participant.
4. Winner Selection and Prize Details
4.1 Each month ten (10) Entries among participants across Canada will be chosen (the ‘’Winners”), during a random draw (thanks to a campaign management platform using a random algorithm) among all eligible Entries received in accordance with these Rules. The draw will take place on these dates: December 6th, 2018, January 3rd, February 7th, March 7th, and April 4th 2019 at approximately 12:00 pm (EDT) at the offices of Deloitte, located at Bay Adelaide Centre, Adelaide Street West, Suite 200, Toronto Ontario, M5H 0A9. Odds of winning the Products (as defined below) depend on the number of eligible Entries received.
4.2 The Winners will be contacted via email (by which they signed up into the Zest by Zantac program) by the Sponsor following the date of the draw. The email will include a subscription certificate. The Winners will need to print, fill out the certificate and mail it to Ricardo magazine to receive their prize (“Prize”).
4.3 Prize description: the Winners (10 winners per month) will each receive a subscription to Ricardo magazine (total of 5 issues per subscription). The total value of the subscription per Winner: $39.50.
4.4 The total approximate retail value for 10 subscriptions (every 5 issues of the Ricardo magazine) won per month is $399.50. Total Contest value (5 months) is $1997.50.
5. Undertaking by Participant
5.1 By entering the Contest, each Participant:
a. agrees to be bound by these Rules;
b. agrees not to hold liable the Contest Entities and their respective directors, officers and employees, for any prejudice, loss or damages of any kind incurred by the Participant or to any other person, sustained wholly or in part, directly or indirectly, from the acceptance, possession, use or abuse of the Product and/or Prize as the case may be, the participation in this Contest, or any activity related thereto; and
c. agrees to indemnify the Contest Entities and their respective directors, officers and employees, for any claims related to any violation of these Rules by the Participant.
5.2 The Participant further accepts to comply with the Sponsor’s decisions, which are final. The Sponsor reserves the right, at its sole discretion, to disqualify a Participant who violates these Rules, disrupt or attempts to disrupt or alter the participation process or the operation of the Contest.
6. Limitation of Liability
6.1 The Sponsor will not be held liable for any entries, communications and responses that are lost, delayed, destroyed or misdirected or for any other technical defect, including those related to computers, software, telecommunications networks, telephones or Internet connections. The Sponsor assumes no liability for false or incorrect information caused either by the users or by any equipment or program associated or used in connection with the Contest or for any human or technical error that may take place during the Contest process.
6.2 The Contest is neither managed nor sponsored by Facebook. The Participant provides its personal information to the Sponsor and not to Facebook. Facebook will not be liable in any way for any issue related to the Contest.
7.1 By entering the Contest, the Participant agrees to the collection, use and disclosure by the Sponsor or its authorized agents of the Participant’s personal information provided through the Entries for the purpose of carrying out the Contest and delivering the Prize.
7.2 Personal information may be transferred to third parties that are retained by the Sponsor to perform storage, management and other similar functions, subject to the laws applicable to the protection of personal information and the Sponsor’s internal policies regarding personal information. Files containing personal information will be kept at the Sponsor’s or its service provider’s offices or on their servers and employees who require access to personal information in order to fulfil their job requirements will have access to these files. To the extent provided by applicable law, the individuals concerned may request access to the file containing their personal information and the correction of such information by contacting the Sponsor at firstname.lastname@example.org.
7.3 The Sponsor may, with the written consent of the Winners, without any additional notice or compensation, copy, reproduce, publish, broadcast, communicate by telecommunication, exhibit, disseminate, adapt, use and reuse his or her name, declarations, image, photos, testimonials or other representations or recordings for publicity purposes relating to the products using any media and in any format.
8. Intellectual Property
8.1 All intellectual property rights in the Contest promotional material, including in the content of any web pages related to the Contest, are held and remain with the Sponsor or its licensors. All rights are reserved. Unauthorized reproduction or use of any material without the express written consent of its owner or holder is strictly prohibited.
9.1 These Rules are the official rules of the Contest. The Contest is subject to all applicable laws and regulations. Subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) when required, these Rules may be modified without prior notice, including to render these Rules compliant with all applicable laws.
9.2 Any dispute respecting the organization or conduct of the Contest may be submitted to the Régie for a ruling. Any dispute respecting the award of the Prize may be submitted to the Régie only for the purposes of helping the parties reach a settlement. The Prize must be accepted “as is” and may not be transferred or converted to cash. The Prize may not be substituted, except at the Sponsor’s sole discretion. All Entries are the exclusive property of the Sponsor and will not be returned. Any attempt to deliberately damage any property or website related to the Contest or to hinder the legitimacy of the Contest process may constitute a violation of civil and criminal laws and the Sponsor reserves the right to initiate legal proceedings and claim damages to the extent permitted by law. The Entries are subject to verification and may be declared invalid if they are illegible, incomplete, mechanically reproduced, damaged, tampered with, falsified or altered in any way. No correspondence will take place in relation to the Contest, except for correspondence with the Winners. The Sponsor reserves the right, subject to the consent of the Régie, to annul, suspend or modify the Contest if a computer problem, an unauthorized human intervention or another cause beyond the control of the Sponsor alters or affects the security, fairness, integrity, management or adequate conduct of the Contest.
